General terms and terms of delivery / Terms of delivery and payment

General terms for customers

 

1.Unless we have explicitly confirmed something else in writing, our terms of delivery and payment apply exclusively. They are also binding if conflicting terms and conditions of purchasing of the customer are not explicitly denied by us.
2.All shipments are at the expense and risk of the customer. We do not pay damages for lost consignments or consignments damaged during transport. Complaints are to be made by the customer at the carrier. The content of the consignment is regarded as consistent with the invoice unless the recipient indicates deviations or claims defects at the latest within one week upon receipt of the consignment.
3. Errors when receiving orders by telephone are at the expense of the customer.

4. We exclude liability for the content of the products distributed by us to the extent permitted by law.
5. Prices are charged in Euros in the amount valid at the time of the delivery. They are ex publishing house, including value added tax, without shipping costs and packaging.
6. Returns due to the granted option of returning are only accepted at the fixed date. We only accept returns if the consignment is in excellent, resalable condition.
7. For the course of business with foreign customers exclusively German law applies.
8. Until complete payment of the invoice amount the delivered goods remain property of the publishing house (§ 455 BGB, German Civil Code).

9. The invoice amount is due net within 30 days from invoicing. Default of payment is at the latest 8 days after the time for payment without the need of a reminder or other requirements. We charge collection expenses and interests for default to the amount customary in banking from default of payment.
10. Place of performance is the place of business of the publishing house. Place of jurisdiction is Geislingen for both parties, if the customer is a general merchant or a corporate body under public law.
11. If one regulation of these terms of delivery and payment is void, the validity of all other regulations is unaffected hereof.
12. The European Commission provides a platform for the extrajudicial settlement (the so- called Online Dispute Resolution) at  http://ec.europa.eu/consumers/odr/.  We are neither ready nor obliged to participate in a dispute settlement process before a consumer arbitration service.
Special regulations for events
1.Contracting partner Contracting partner for the presence or online seminar is C. Maurer Fachmedien GmbH & Co. KG (below called „event organizer“) unless otherwise indicated in the event description.

2. Registration Registrations for the event require generally the written form and have to have a valid signature. Incoming online registrations via Internet and e-mail currently do not now an electronic signature. Especially the attendance of event elements such as factory tours and similar things is numerically limited and therefore the registrations will be considered according to their date of receipt. Upon the receipt of the registration a confirmation of the registration and an invoice are sent. The invoice needs to be settled generally before the beginning of the event. There is no general entitlement to participation; The event organizer reserves the right to admit the participation on an individual basis. Possible faulty or twofold made orders have to be indicated to the event organizer immediately and without being asked in writing.

3.Services Unless otherwise agreed upon, the services listed in the event description are included in the event price, unless agreed upon otherwise. The prices are plus legal value added tax, unless stated otherwise. The offered services are exclusively for commercial/free-lance users. The attendance of private persons in terms of § 13 BGB (German Civil Law) of events of C. Maurer Fachmedien GmbH & Co. KG is excluded..

4. Due date/payment The attendance fee is due upon the receipt of the invoice that has to be settled immediately and without any discount. Only payments that are received in time before the beginning of the event entitle to participation of the event.
5. Bank account details Payments are carried out by direct debit from the account of the participant or by bank transfer, unless stated otherwise in the event description, to the account of C. Maurer Fachmedien GmbH & Co.KG, Kreissparkasse Göppingen, IBAN: DE14 6105 0000 0049 0557 48.
 6. Cancellation In case of a previously determined date of the event (e.g. presence seminar, online-webinar): If we receive the cancellation from a participant at the latest 30 days before the beginning of a seminar, the participant does not have to pay any amount of the seminar fee.  In case of later cancellations or if the event is not attended, 100 % of the seminar fees have to be paid. Rebooking to a substitute participant is possible at any time free of charge. In case of events without a determined start date (Online-learning platforms on certain topics): In case of cancellations or non-attendance of an event 100 % of the seminar fees have to be paid. Rebooking to a substitute participant is possible at any time free of charge. Rebookings and cancellations have to be done in writing in any case and are only legally valid through the event organizer’s reconfirmation.
7. Number of participants If the maximum number of participants of the event is limited, it will be indicated in the event description. In this case the places are allocated according to the entry of the registrations. There is no right to a place. The registration is only legally valid through the event organizer’s confirmation. If the minimum number of participants, determined by the event organizer, is not reached, the event organizer reserves the right to withdraw from the contract. The events take place at the venue published in the event description, unless it is an online event. If there is a short-term change of the venue, the participants will be informed in time by the event organizer.
8. Copyright: The documents of the event are protected by copy-right and non-material property of the event organizer or the cooperating partner of the event organizer. The event documents are exclusively intended for individual-company use. This also concerns the possible access authorizations for online events. Any copying, reprinting or translating and passing on to third parties also of parts of documents without explicit consent by C. Maurer Fachmedien GmbH & Co.KG is not permitted and constitutes a copyright infringement. All film and sound recordings during the event require the previous permission of the event organizer. Photos for private use are permitted to a reasonable extent. The event organizer does not assume responsibility or liability for possible incorrect lectures or documentations with regard to contents.
9. Cancelling of the event or of parts of it: If the event cannot be carried out due to force majeure, prevention of the speaker, disturbances at the venue or due to insufficient number of participants, the participants will be informed right away. The cancellation due to an insufficient number of participants occurs no later than 2 weeks before the event. In case of a complete cancellation (exception: force majeure) of the event, the fees for the event that have already been paid will be refunded or a credit voucher is issued.
10. Exhibition/Sponsoring
The conditions for the accompanying trade exhibition/the sponsoring are ruled in the conditions specific to the event respectively.
11. Liability limitations: The offered events are diligently prepared and carried out by qualified chairpersons and speakers. C. Maurer Fachmedien GmbH & Co.KG does not assume any liability for the timeliness, correctness and completeness of the presented contents. The event organizer is not liable for the loss or damaging of brought along objects at events, unless the loss or the damaging of these objects is ascribed to deliberate or grossly negligent behavior of our staff or other auxiliary persons. The event organizer therefore would like to ask you not to leave any valuables or important materials in the seminar room during the breaks. The event organizer does not assume any liability for other immediate damages and costs including loss of earnings, loss of profit or claims of third parties, data loss, travel expenses, secondary damages and property losses of any kind that may derive from the cancellation of the event.
12. Data protection We protect personal data of the participants. We will treat the data received from the participants as confidential and only in accordance with regulations in terms of data protection law. Personal data are all data saved in connection with the names of participants. The inventory data transmitted by participants are collected by us, saved in a customer file and processed, used and not passed on for the purpose of rendering a service. We will inform the participants in the future about our event program. Participants can revoke their consent to this at any time. If networking is a partial aim of the booked event, names, institutions and e-mails of the participants are published in a list of participants and passed on to the other participants and lecturers and partners of the same event. The participants can revoke their consent to this. 13.Final regulations: For this contract and its implementation, as well as for all events of C. Maurer Fachmedien GmbH & Co.KG,  exclusively the legislation of the Federal Republic of Germany applies. Place of performance and exclusive place of jurisdiction is Geislingen/Steige. The conditions of participation and the terms remain binding in the remaining parts also if individual regulations are legally void. Void provisions are replaced by provisions that come closest to the economic purpose of the void ones. Agreements differing from this contract are only valid if they are in writing.
